James Malcom RS Last Will and Testament

Recorded in Morgan County, Georgia Will Book 1815-1830, pp. 256-257

In the name of God Amen.

I JAMES MALCOM of the State of Georgia & County of Morgan being poorly in body but of sound mind and memory do make this my last Will & testament. First of all I commit my soul to God and my body to be buried at the discretion of my friends. And as touching my Estate my Will and desire is that my Just debts be paid.

Item First

I give and bequeath to my beloved daughter MARY CONNOR formerly Mary Malcom one dollar ready money. Item Second I give and bequeath to my beloved son DAVID C. MALCOM two Negroes namely Jacko and Henry. Item Third I give and bequeath to my beloved daughter ELIZABETH ADCOCK formerly Elizabeth Malcom one dollar ready money. Item Fourth I give and bequeath to my beloved son GANOWAY MALCOM two Negroes Namely Charles & Jobe. Item Fifth I give and bequeath to my beloved son JOHN MALCOM two Negroes namely Peter & John. Item Sixth I give and bequeath to my beloved daughter SALLY ADCOCK formerly Sally malcom one dollar ready money. Item Seventh I give and bequeath unto my beloved son JAMES MALCOM two Negroes Namely Dave & George. Item Eight I give and bequeath unto my beloved son GEORGE W. MALCOM two Negroes Namely Jow? and Sarah Item Ninth I give and bequeath unto my beloved daughter NANCY ROBERTSON formerly Nancy Malcom four Negroes Namely Mariah Harriett Reuben and Israel, Also two hundred dollars in money. Item Tenth I give and bequeath unto my beloved daughter ANNA HERNDON formerly Anna Malcom one dollar ready money. Item Eleventh My Will and desire is that my five sons to wit David Malcom Ganoway Malcom John Malcom James Malcom and George W. Malcom have all my land estate to be equally divided between them. I do hereby constitute & appoint as my Executors to this my last Will and testament David Malcom & Ganoway Malcom. ~ Item Twelfth My will and desire is that my Executors above mentioned do carry this my last will & testament into effect.

Personally appeared in Open Court Wiley Burk & Lorenzo D. Straughn subscribing witnesses to the foregoing instrument in writing purporting to be the last will & testament of James Malcom of said county deceased. Who being duly sworn saith they saw the testators sign, seal & deliver the same for the purposes therein mentioned and that they believe he was of sound mind and disposing memory and that they listed the same as Witnesses, in his presence and saw James Cocks subscribe his name as a witness, together with themselves.
