Ganaway Malcom Last Will and Testament

[This document is not dated. Note that there is no mention of Hillsman, Thurmond, or Nancy J. Hawk, who Ganaway presumably raised after their father William Hawk died in 1814. They were all married off by 1838, but then so were several of Ganaway’s own children.]

Georgia Morgan County. I GANNOWAY MALCOM of the County and State aforesaid being sick of body but of sound mind and memory do hereby make this my last will and testament as follows.

Item 1st

It is my will that all my just debts be paid.

Item 2nd

It is my will that all my property both real and personal belonging to my Estate be disposed as follows:

Item 3rd

It is my will that my beloved wife REBECKA MALCOM hold the land and the proceeds thereof untill my daughter REBECKA comes of age, or my wife her lifetime, also all the negro property accept what I now to my children, viz. Arnold, Milbary & family & Louisa provided there is money sufficient to pay my debts. If not she must be sold and Fanny child Sela and Milbary child Martha. The above named property to remain in the hands of my wife for the maintaining and education of my minor Children.

Item 4th

I give to my son JOHN MALCOM one negro boy named Hampton.

Item 5th

I give to my daughter CHARITY one negro boy Judge.

Item 6th

I give to my son WILSON MALCOM negro boy Greens

Item 7th

I give to my daughter MARY ANN MALCOM one negro boy Seaborn.

Item 8th

I give to my daughter SARAH MALCOM when of age five hundred Dollars worth of property of my Estate in the hands of my Executor.

Item 9th

I give my daughter JUDA MALCOM when of age five hundred dollars worth of property as above mentioned.

Item 10th

I give to my daughter REBECCAH MALCOM when of age five hundred dollars worth of property as above.

Item 11th

I give to my daughter ELIZABETH WILLIAMS the land she now lives on and other effects that I consider worth to her five hundred dollars.

Item 12th

I give to my daughter PERMELIA BLASSINGAME land and other effects that I consider worth five hundred dollars to her.

Item 13th

I have given to my son BARNET MALCOM five hundred dollars worth of property land and other effects.

Item 14th

It is my will that my sons John and Willson have my land equally when my youngest child comes of age - the land I now live on.

Item 15th

It is my will after the death of my wife Rebecka Malcom and the foregoing distributions the remains of my property to be equally divided amongst all my Children, viz. BARNET, JOHN, WILLSON, PERMELIA, ELIZABETH, CHARITY, MARY ANN, SARAH, JUDA, Rebecka.

I appoint my son Barnet, John & Wilson Malcom my Executors of this my last Will and testament.

Inferior Court Sitting for Ordinary Purposes adjourned Term. 15th day of January 1838

Personally appeared in Open Court Thomas V. Allen, John Malcom, & Thomas Swift, subscribing witnesses to the foregoing instrument in writing purporting to be the last Will and testament of Ganoway Malcom, deceased, who being duly sworn deposeth and saith that they saw the testator sighn seal and deliver the same for the purposes therein expressed & believe he was at the time of sound and disposing mind and memory and that they listed the same as witnesses in his presence and in the presence of each other. Sworn to & subscribed in Open Court this 15 January 1838.
